A judge made several decisions in the legal battle concerning several Marvel characters such as Spider-Man, Iron Man, Thor, X-Men, and Hulk. New York federal judge Colleen McMahon rejected a bid by Marvel to throw out the Kirby estate's main counterclaim. However, the judge did trim several counterclaims by the Kirby estate. Judge McMahon essentially narrowed the case to Jack Kirby's working environment in the 50s and 60s when he and Stan Lee began many Marvel characters. Despite Marvel's attempt to keep their corporate parent out of the battle, the judge ruled that The Walt Disney Company will be involved since it will profit from Kirby's work. McMahon will soon look at Kirby's work history and some of the loose contracts and oral agreements that guided his efforts in those years. [19]

Stan Lee is being sued by Super 7. At Comic-Con Lee announced Stan Lee's "Super Seven," which centered on the 87-year-old Lee struggling with writer's block and encountering a spaceship of aliens in the desert. Lee takes advantage of their powers and assigns them superhero identities and tasks to perform. The toy manufacturers filed a complaint in U.S. District Court in California against Lee, POW! Entertainment, A Squared Entertainment, and other entities, alleging trademark infringement and unfair competition. A lawyer for one of the defendants said that his clients now planned to use "Stan Lee and the Super Seven" as a trademark in connection with comic books, television, online programming and other works. However, Super 7 wants a court to issue an injunction and the company also demands a disgorgement of profits as well as compensatory damages. [130]

Marvel has released the creative team behind the upcoming Ultimate Spider-Man. The team includes Paul Dini (of Batman: The Animated Series), Brian Michael Bendis (creator of the Ultimate Spider-Man series), and Man of Action Studios's Joe Casey, Joe Kelly, Duncan Rouleau, and Steven T. Seagle (all of Ben 10). Dini will serve as the series Creative Consultant and write the series pilot. Man of Action Studios will serve as supervising producers and direct the writing staff, generate scripts, and story edit. Bendis will oversee the project as Consulting Producer. [131][132][133]

Paul Dini (known for his renowned work on Batman: The Animated Series and the DC Animated Universe, Lost, and Batman: Arkham Asylum) has been hired to work on Ultimate Spider-Man. Dini revealed that the producers are currently creating twenty-six episodes, and that the series will be a combination of the Ultimate Spider-Man comics and new material. [134][135]

Marvel announced today it is seeking a judicial declaration saying that the Jack Kirby heirs' copyright claims are invalid. Last September, attorneys on behalf of the Kirby estate sent 45 notices to Marvel seeking to terminate purported assignments by Kirby of copyright interests in Marvel superhero characters such as X-Men and Fantastic Four. However, Marvel's lawsuit asserts that those claims are baseless because all of Kirby's contributions to Marvel's publications, like those of other comic book writers and artists of the same period, were works made for hire, making Marvel the sole owner of the copyrights. Under federal copyright law, works that were created at the "instance and expense" of a publisher during the time Kirby was a creator for Marvel were "works made for hire" and owned by that publisher. All of Kirby's contributions to Marvel comic books the heirs are claiming for themselves fall into this category. Marvel editors determined which publications Kirby would work on, just as they did with all the other artists and writers engaged to work on the publications, and always retained full editorial control. In addition, Kirby was paid for his contributions. As a result, all of Kirby's contributions were solely owned by Marvel, which was standard practice in the comic book publishing industry. [341]
